Wourdoboros Terms of Service

Wourdoboros is a word game made by Catro Creative LLC ("we", "us").

Our registered postal address is being finalised with our registered agent and will be added here as soon as it is. Until then, reach us at the email address in the contact section below.

We have tried to write these in plain words. Where a sentence gives us a power over your account, we have said what the power is for and what it does not cover, because a term you cannot understand is not really an agreement.

There is a separate Privacy Policy at https://wourdoboros.catro-creative.com/privacy-policy which explains what we hold about you. These two documents are separate and neither replaces the other.

1. Your account

Wourdoboros creates an account for you the first time you play. It is not something you sign up for: you are never asked for an email address, a password or a name, and we do not have one for you.

When these terms start applying to you. They apply whenever you play. We show you a notice saying so the first time you open the game, with a link to this page, and we keep showing it until you have read it.

We also ask you to accept these terms at the two points where they start to matter most: the first time you choose a player name, because that is shown to other people, and the first time you buy anything. Accepting is a separate step from being shown the notice, and we record the two separately.

That account design has two consequences:

• Your account lives on your device. If you lose the device, uninstall the game, or clear its data, the account and everything in it can be lost. We cannot look you up by email, because no email is attached to it.
• We cannot restore an account we cannot identify. If you write to us about a lost account, we will try, and we will tell you plainly if we cannot.

Where the game offers a way to link your account to a store account so it can be recovered on a new device, using it is the reliable way to keep what you have bought.

Your account is yours personally. Do not sell it, rent it, or transfer it to anyone else, and do not buy one from anyone else.

2. Coins, and what buying them gets you

Coins are not money and they are not property. When you buy coins you are paying for a limited, personal, non-transferable permission to use them inside Wourdoboros. You do not own them, they have no value outside the game, and they can never be exchanged, cashed out, or transferred to another player or another account.

What coins buy. Coins buy cosmetic items — the appearance of your tiles and your player mark.

What we may change. We may change the price of an item, stop offering it, or add new ones, and we may change how many coins a pack contains. If we stop offering an item you already own, you keep it — we will not take a purchased item off your account because we have retired it from the shop.

We do not vary prices between individual players.

3. Payments and refunds

Purchases are made through Google Play, which is the seller for the transaction. Your payment goes to Google and not to us, and Google's terms and refund policy apply to it.

Google is the seller, so a refund is Google's to give. Refunds are requested from Google Play, and Google decides them.

This does not limit any refund right the law gives you. Where the Australian Consumer Law, the New Zealand Consumer Guarantees Act, or another law where you live gives you a remedy for digital content that is faulty or not as described, that remedy stands and nothing here reduces it. Tell us and we will help you get it, even though the payment itself is Google's to reverse.

If a purchase is reversed. If a purchase is refunded, charged back, or otherwise reversed after coins have been credited, we may remove those coins from your balance. If you have already spent some of them, your balance can go to zero, but it will never go below zero and we will not pursue you for a shortfall. Where a pattern of buying, spending and refunding suggests deliberate abuse, we may also restrict the account — a person reviews that, not a program.

We may also decline to credit a purchase we cannot verify with Google.

4. Playing fairly

Do not cheat. No bots, automated play, modified clients, tampering with the game or the network traffic between it and us, and no exploiting a bug instead of reporting it.

Do not use another account to feed your own. Wourdoboros matches you against recordings of other players' rounds. Arranging matches against accounts you control, so that you win easily, is cheating even though nobody else is harmed directly.

What we may do about it

• Hold a win pending review. A result that looks arranged is held rather than awarded while a person looks at it. If the review clears it, the result stands.
• Void a result that was manufactured.
• Restrict or close an account for repeated or serious breaches of these terms.

5. Your player name

The only thing you write in Wourdoboros that other players see is your player name. There is no chat, no messaging, and no comment or text box anywhere in the game.

Choose a name you would be happy to have shown to a stranger. Names that harass, impersonate someone, or are unlawful, hateful or sexual are not allowed.

If a name breaks that rule, we may reset it. The account keeps everything it has — its coins, its items, its record — and simply loses the name, which you can then set again.

You can report a player name from inside the game, on the screens where other players' names appear. Reports go to a person.

You can also hide a name, which stops us showing you that player's name anywhere. It does not change who you play against — hiding a name is about what you see, and matches are drawn from everyone.

You keep whatever rights you have in the name you choose. We do not claim any licence to it beyond showing it to other players inside the game.

6. Age

You must be at least 13 to use Wourdoboros.

If you are under the age of majority where you live, you may only use Wourdoboros with the agreement of a parent or guardian.

7. Deleting your account, and us closing it

You can delete your account at any time, from inside the game and from https://wourdoboros.catro-creative.com/account-deletion. Deletion is immediate. There is no waiting period and no way for us to undo it.

You can also take a copy of your data before you delete it, from inside the game. It is plain text you can read and keep. The Privacy Policy says what a copy leaves out and why.

What deletion removes and what survives is described in the Privacy Policy and at the deletion page.

Deleting your account does not refund anything. Coins and items are lost with the account.

We may close an account for a serious or repeated breach of these terms. We will tell you when we do, unless we are prevented from doing so. Because we hold no email address or phone number for you, telling you means a message shown in the game the next time it is opened, or a notice at https://wourdoboros.catro-creative.com. Coins and items are lost with the account in that case too.

8. Changes to these terms

We may change these terms — the game changes, and the law does too.

We will publish the new version with a date on it at https://wourdoboros.catro-creative.com/terms, where every earlier version stays available so you can read the one you agreed to.

A change that only gives you more applies straight away. We do not ask you to accept something that cannot leave you worse off.

A change that could leave you worse off, we ask you to accept. That means any version which takes away something you had or widens what we may do — and if one part of a change does that, we treat the whole version that way, even where other parts are in your favour. We will tell you in the game at least 30 days before such a change takes effect, and we will say what is changing.

If you do not accept, you keep everything you have. Your account, your coins and your items stay yours. Where the change does not alter how the game behaves, you can carry on under the terms you already accepted. Where it does, you will need to accept the new version to keep playing, because the game cannot run two sets of rules at once. Either way, nothing is taken from you for saying no.

9. If we stop running the game

We may stop offering Wourdoboros, or any part of it. If we do, we will tell you at least 30 days before the game closes, so that you can spend or enjoy what you have bought rather than discovering it is gone. If something outside our control closes the game faster than that, we will tell you as soon as we can.

We cannot promise to refund coins if that happens, and you should not treat coins as a store of value.

10. What we do not promise

Wourdoboros is provided as it is. We do not promise it will be available without interruption, free of bugs, or that any particular feature will keep existing.

What we are responsible for. If we cause you loss, what you can recover from us is limited to the greater of what you paid us in the twelve months before the loss, or USD 20. We are not responsible for losses that are not a foreseeable result of something we did wrong.

Except where the law says otherwise, and it often does. Nothing in these terms excludes or limits anything that cannot be excluded or limited where you live. The Australian Consumer Law guarantees, the New Zealand Consumer Guarantees Act and Canadian provincial consumer statutes all give you rights that no agreement can remove, and this section does not try to. Where they apply, they win over the paragraph above.

11. Disputes and governing law

These terms are governed by the law of the State of Washington, USA, and a dispute may be brought in its courts.

Except where the law where you live says otherwise. If you live somewhere whose consumer law gives you rights that cannot be varied by agreement, those rights apply to you, and you may bring a claim in the courts where you live. This is not something we choose to allow; it is how those laws work, and we would rather say so than write a clause a court would set aside.

12. The game itself

Wourdoboros, its software, its artwork and its name are ours. You may install it and play it for your own personal enjoyment, on your own devices. That is the whole of the licence we give you, and it is all the game needs.

13. Other terms

If you installed Wourdoboros from Google Play, Google's terms also apply to your use of the app and to any purchase you make through it. Coins are sold only through Google Play, so a version of the game outside the store has no shop in it.

If any part of these terms is found unenforceable, the rest continues to apply.

These terms, together with the Privacy Policy and — where you installed from Google Play — Google's own terms, are the whole agreement between us about Wourdoboros. That does not shut out anything we have actually told you elsewhere: if we made a claim about the game somewhere you read it, we are answerable for it. We may transfer these terms to another company if the game changes hands; your rights are not reduced by that.
